I understand that SiteOne Landscape Supply, LLC (“SiteOne”) makes deliveries at the request of the customer for the customer’s convenience. I have requested that SiteOne deliver certain nursery or landscaping products and I understand that such delivery may be made by commercial vehicle, to include a forklift (where applicable) or other vehicle type, depending on the type of product being delivered. SiteOne is willing to make delivery of the products, subject to the following conditions: 

 

I understand that I will assume any and all risk and SiteOne will not be held responsible for any claims and liabilities arising from or as a result of delivery, placement, installation and use of the products, including but not limited, to accident or injury to persons or property during or after such delivery (ex. cracked curbs, driveways and sidewalks, landscaping, irrigation systems, vehicle damage, lamp posts, and outdoor lighting). Any fees or costs of repair arising from such damage shall be the sole responsibility of the customer.  I ACKNOWLEDGE THAT SITEONE IS PROVIDING DELIVERY ON AN “AS-IS” BASIS AND SUCH DELIVERY IS WITHOUT ANY WARRANTY OF ANY NATURE WHATSOEVER.

 

I release and agree to indemnify and hold harmless SiteOne, its affiliates and assigns, including direct and indirect parent and subsidiary companies and directors, officers and employees, from any claims, liability, losses, costs, damages, and expenses of any kind which might arise as a result of delivery and the presence of SiteOne equipment, personnel or contractors on the subject property, to include, but not limited to personal injury, property damage (as discussed above), and any related legal and administrative costs.

 

By electronically accepting the waiver and release, I hereby give SiteOne permission to deliver items as requested to the subject property, and I agree to the terms as expressed above. I certify that I am the correct party to sign on behalf of the property owner.
